| Near North, which earlier this year sued three former employees it claimed violated noncompete agreements, said it filed a civil action under the federal Computer Fraud and Abuse Act against three former technology employees who allegedly used insider knowledge of the company's computers to hack into the system, read company e-mail and conceal their actions. This is the approach taken by the Computer Fraud and Abuse Act (CFAA)(3), which provides criminal penalties for either knowingly or recklessly releasing a computer virus into computers used in interstate commerce. However, conviction under the Computer Fraud and Abuse Act can entail prison sentences of up to five years per incident (10 years for second-time offenders) and a $250,000 fine. |
