The tale, written in Oshindonga and English, was part of the Writing for Kids project, a NIED (National Institute for Educational Development) programme designed to promote the literacy of young learners through stories which carry positive local messages.
In his brief, Schermerhorn noted that "there has been no floodgate of litigation since Sacco was decided in 1995," that the Sacco court had "repudiated the 'flood gate' rationale," and that "affirming the lower court decision subjects victims' rights to arbitrary lines of proximity and distance, and all but eliminates discretion in analyzing NIED claims.
Nash was not entitled to recovery on his NIED claim because he was not aware of any injury to the baby until "after" the injury producing event.
