Assignment (also cession), the transfer of a creditor’s rights to a third party, who then becomes the new creditor. In Soviet law, assignment is possible only when it is not in contravention of laws or agreements and when the claim transferred does not pertain directly to the personality or individuality of the creditor. For example, the right to alimony cannot be transferred. Assignments depend only on the creditor and the third party; the agreement of the debtor is not required. Want to thank TFD for its existence?
