Odukoya is alleged by the EFCC to have used the false document, and also gave false information on oath, concerning the loss of the
certificate of occupancy at the Lagos State Land Registry.
Alao, who spoke during a telephone chat with the TribuneOnline on Tuesday said the land was given to the Adeleke family by the predecessor to the current Timi of Ede, Oba Munirudeen Adesola Lawal, emphasising that
Certificate of Occupancy (C of O) in possession of the university was issued by the state government
According to him, signing the agreement was like giving the
certificate of occupancy to a tenant in the house.
"The tenant must make alterations, so they may choose the option to change use and obtain a
certificate of occupancy, although the five-work use must be approved by the management.
'A declaration that the forceful seizure of the original
certificate of occupancy of the applicants' property by the respondent since 23rd of July 2014 without cause or any court order is illegal, wrongful, unlawful, oppressive, unconstitutional as it violates the applicant's fundamental rights as guaranteed under sections 36, 43 and 44 of the constitution.
The $470,000 is only a fraction of the total cost of the construction that one architect estimated would be required to secure a permanent
certificate of occupancy for the building, according to court documents.
Getting
Certificate of Occupancy takes a while and this certificate must be made available for any loan facility from the Bank of Industry.
The loan will finance the borrower's purchase of the existing debt from CPC, as well as construction costs needed to obtain a
certificate of occupancy for a portion of the project.
