A bargain between the satellite, broadcast, and cable industries, section 122 grants satellite rebroadcasters a free (no royalty) compulsory license for local broadcasting, provided they agree to carry all television broadcast stations located within the local market.
This may be the case particularly in the broadcasting context, where virtually every act of rebroadcasting will be a prima facie infringement of copyright, and where rebroadcasters may not wish to risk court proceedings and may thus accept unfavourable licences.
Internet rebroadcasters claimed Section 31 allowed them to help themselves to over-the-air signals, too.
