He said that he was upset about the way the
Solicitor-General's office was being treated by the government in the case involving the 2G scam.
'Hence, technically, a solicitor-general sitting in for the AG can very well execute all the reforms contained in the government's manifesto,' he told Malay Mail when contacted yesterday, citing the Federal Constitution's Eleventh Schedule's Section 40A and the Criminal Procedure Code's Section 376(2).
After the PH coalition came into power in the 14th general elections and formed the new government, Apandi was placed on indefinite leave while his deputy, Solicitor-General Datuk Engku Nor Faizah Engku Atek filled in for him.
Because Prime Minister Tun Dr Mahathir Mohamed has yet to appoint a Federal Territories minister and has put AG Tan Sri Mohamed Apandi Ali on garden leave, the position of the minister in the Board will be presumably left vacant while the other will be filled in by
Solicitor-General Datuk Engku Nor Faizah Engku Atek.
The
Solicitor-General is currently Datuk Engku Nor Faizah Engku Atek, who has the powers of a deputy public prosecutor and may assume the AG's prosecutorial role in the latter's absence or incapacity.
'AG will be on leave and his place in the Pardons Board will be taken over by the
Solicitor-General, who can execute the role of an AG,' he said.
Tang, former assistant
solicitor-general, was appointed as Sandiganbayan Associate Justice only last year.
