Only this second action, were it not requested--that is, the download took place without requiring the consent of the affected party--, could be considered a case of spam -a supposition that has given rise to the name bluespam but not, we insist, the simple request for consent from the owner of the device in order to initiate the reception of the message on the terminal.
For example, German Bluetooth researcher Collin Mulliner released a software tool called BlueSpam that "searches for all discoverable Bluetooth devices and sends a file to them (spams them) if they support OBEX," according to a Mulliner's Web site.
