Before filing a revised second amended complaint, the plaintiff's attorney sent the defendant's attorney a courtesy copy
. Two days later, on October 7, 2005, the defendant's attorney wrote to the plaintiffs attorney advising him that the revised second amended complaint was "flawed" in that it: (1) included claims of retaliation and harassment that had been stated in the original complaint but had been omitted from the FAC, (2) alleged a cause of action against Sutter Health, which by then had been dismissed as a defendant, (3) included the medical disability language that the court had ordered stricken, and (4) alleged facts that were contrary to the plaintiff's deposition testimony.
