Both pilots are making decisions in compliance with the regulations: The Part 135 (or Part 121) pilot may not begin an instrument approach procedure if the current weather report available to the pilot says the airport is below IFR landing minimums
for the approach (FAR 135.225).
Section 135.217 of the FARs states, "No person may take off an aircraft under IFR from an airport where weather conditions are at or above takeoff minimums but are below authorized IFR landing minimums
unless there is an alternate airport within one hour's flying time (at normal cruising speed, in still air) of the airport of departure.
