TACOMA, Wash., Sha'ban 24, 1437, May 31, 2016, SPA -- Federal prosecutors said Tuesday they will retry the elected Washington state auditor on charges he pocketed millions of dollars in needless fees while running a real estate services business a decade ago, after his five-week fraud trial ended in April with a
hung jury, AP reported.
Deputy District Attorney Steve Hoddle has filed a motion asking Douglas County Circuit Judge Randolph Garrison to accept the jury's 11-1 verdict against William Aguayo as guilty instead of declaring a
hung jury, the Roseburg News-Review reports.
And when a first trial last year ended with a
hung jury, he said he knew he had to back up those allegations.
Legal observers blamed the
hung jury on the lack of a manslaughter option.
The role of the
hung jury is to protect the minority of people from the dangers of majority rule.
DJ Dave Lee Travis was the first person to go through a trial under Yewtree, but the proceedings ended with him being acquitted on 12 indecent assault charges, and a
hung jury on one count of the same charge and a count of sexual assault.
The first four-month trial ended in a
hung jury last August.
But it apparently persuaded two jurors at his second trial, which ended in March with a
hung jury. Isaacs told Adult Video News correspondent Mark Kernes there were two holdouts, both women.
The first trial resulted in a
hung jury while the re-trial was halted when a senior barrister fell ill.
Geragos said he believes prosecutors could have a difficult time winning a conviction -- and that a
hung jury with no conviction or acquittal is more likely.
A
hung jury resulted in a mistrial, after which a second grand jury brought more than 100 new charges against him.
"Typically when you have a
hung jury and the case gets retried it is better for the prosecution than the defense; and this proves it again," said Peter A.
